TRIDYMAKER
TERMS OF USE

Article 1 - Definitions
 
The terms defined below have the following meanings in these terms:
 
"TridyMaker" means TridyMaker, limited liability company with capital of 1,000 euros with its registered office 10, boulevard de la République responsibility - 13001 Marseille, registered with the Trade and Companies under number Marseille 799430277, whose number VAT identification FR84799430277 and whose customer service is available by email at info@tridymaker.com and by phone at 0492957057.
 
"Customer" means any person who performs the and / or services on the Site for purposes not within the scope of his trade, business, craft or profession purchase Products [A1].
 
"Modeling" means the design TridyMaker, at the request of the Client and on the basis of information provided by the latter, 3D models can be 3D printing.
 
  "Products" means the products sold by TridyMaker through the Site, including, without this list being exhaustive: 3D printers, 3D scanners, accessories and consumables for 3D printers, print objects from models available in catalog .
 
"Services" means the individual services sold by TridyMaker through the Site, including, without this list being exhaustive: 3D printing objects from templates provided by the Client, Modelling, 3D printing of objects made on the basis of modeling.
 
"Site" means the website accessible at the following address: http://www.tridymaker.com.
 
 
ARTICLE 2 - PURPOSE
 
2.1 These terms are intended to define the contractual framework for the purchase by the Customer of the products and / or services marketed by TridyMaker through the Site.
 
2.2 These terms and conditions form the set of contractual arrangements in this context, the relationship between the Client and TridyMaker.
 
2.3 The successful completion of the procedure for ordering referred to in Article 4 implies full acceptance of these terms simultaneously communicated to the Client.
 
 
Article 3 - Price
 
3.1 The prices of products and services for sale on the site included in the fee schedule available on the website at the following address http://www.tridymaker.com/fr/content/3-conditions-d-utilisation
 
3.2 Notwithstanding the foregoing, for services including modeling, the Customer must request a quote on the Site in the manner set out in Article 4.3.
 
3.3 The prices of products and services sold through the Site are quoted in euros and are inclusive ("TTC") and excluding delivery costs in the amount mentioned on the Site all taxes.
 
3.4 Any purchase of products or services by the Customer will be charged by TridyMaker based on the price including VAT and delivery charges in effect when the full completion of the ordering procedure referred to in Article 4.
 
3.5 Each invoice issued by TridyMaker accordance with the provisions of these terms is payable as described in Article 4.
 
3.6 The Client is expressly informed that no order can be prepared or shipped until the total price has not been paid in full.
 
 
Article 4 - Change of command
 
4.1 Control Products
 
Ordering products on the Site requires the perfect completion of all of the following steps:
 
- On Site, the Customer must select each desired product, then add it to the basket by clicking on the "+ Add to Cart", the Customer can then change the quantity of each product and added to the basket;
 
- In the next step, the Customer must sign and enter their email address and billing address and delivery (if different);
 
- After intelligence information delivery, the Customer must accept these Terms and Conditions;
 
- Finally, the last step, the Customer must pay the full amount of the order. Once payment is accepted, the order is confirmed definitively.
 
4.2 Control Services (except services including modeling)
 
Ordering services on the Site, with the exception of services including modeling, requires the perfect completion of all of the following steps:
 
- On Site, the Customer must complete an order form and attach (or) file (s) from which (or whom) he wants to get a 3D printing;
 
- In the next step, the Client makes the corresponding payment. The customer then receives an email informing consideration of the application. This email only valid in any case control permanently between the Client and TridyMaker;
 
- As submitted by the Customer to TridyMaker his order, TridyMaker has a period of [complete] days to validate the technical feasibility of the order or to reject it. If TridyMaker determines in its sole discretion, that the impression of an object from the information provided by the Client is technically possible, it sends the client an email order confirmation by email. This email address valid control permanently between the Client and TridyMaker. In case of express command or reply by TridyMaker within the aforementioned release, the order is deemed rejected. The Client is automatically refunded in the manner set out in Article 5.
 
4.3 Control Services including modeling
 
Prices of services including modeling are available on request.
 
Ordering services including modeling requires the perfect completion of the following steps:
 
- The Customer must first request a quote on the website by filling out the form provided for this purpose and joining elements from which he wants TridyMaker design a model;
 
- If TridyMaker determines in its sole discretion, that the modeling is technically possible, it sends the client a quote by e-mail;
 
- The Customer can then confirm the order on his client space by accepting the quote. Where applicable, the Customer shall pay;
 
- Once the payment is accepted, TridyMaker address an email confirmation of the order by the Customer. This email address valid control permanently between the Client and TridyMaker.
 
 
ARTICLE 5 - RELEASE CONTROL SERVICES BY TRIDYMAKER
 
TridyMaker reserves the right to reject any order for services in the following cases:
 
(i) When the command involves creating models or feel objects contrary to public order or morality. In particular, but not limited to, TridyMaker reserves the right to refuse any order of services involving modeling or printing firearms or objects racist, discriminatory or pornographic;
 
(ii) When the order clearly violates the intellectual property rights of a third party;
 
(iii) When TridyMaker determines in its sole discretion, that the performance of the Services is technically impossible in the light of information provided by the Client.
 
In case of rejection of an order for services, TridyMaker will reimburse the Client within 14 days from the date on which the Customer is informed of the rejection of his order by TridyMaker. In any event, the refund will be made within a period greater than 30 days from the date of payment by the Client.
 
 
Article 6 - Right of withdrawal
 
6.1 Right of withdrawal under the orders of Products
 
Pursuant to Article L. 121-21 of the Consumer Code, the Customer has a period of fourteen days to exercise his right of withdrawal by returning the standard form [A4] joined Validation Email command that was sent by TridyMaker or by sending an email to this effect TridyMaker at the following address: info@tridymaker.com
 
The withdrawal period runs from the date of receipt by the Customer to the Product delivery address when ordering.
 
Customer agrees to return the Product ordered TridyMaker later than fourteen calendar days following the notification of its decision to retract TridyMaker.
 
It is expressly agreed that the cost of returning the Products ordered are the sole responsibility of the Customer.
 
Subject to referral by the Client (or) Product (s) ordered (s) within the said period, the refund will be not later than fourteen days from the date TridyMaker was informed of the decision Customer retract. The Customer acknowledges and agrees, however, that TridyMaker may withhold the reimbursement until recovery (or) Product (s) corresponding (s) or until the Customer has provided proof of shipment of the Products, whichever is the earliest of these facts.
 
6.2 No right of withdrawal under orders benefits
 
The performance of the Services by TridyMaker involves the creation of clearly personalized models and / or printing of objects according to customer specifications.
 
Therefore, in accordance with Article L. 121-21-8 3 of the Consumer Code, ordering services on the Website by the Customer is not subject to the application of the right of withdrawal provided for in terms of distance selling.
 
 
Article 7 - Delivery
 
TridyMaker undertakes to deliver to the address specified by the customer during the checkout procedure referred to in Article 4, the Products and / or objects conceived as a result of the execution of services in the maximum time following:
 
- Deliveries in France: 5 clear days from the date of the order;
 
- Deliveries outside France: 7 days from the date of the order.
 
 
Article 8 - Guarantees INFORMATION
 
Under the conditions defined by the regulations, the Products and / or Services provided by TridyMaker Customer benefit:
 
(i) The guarantee for non-compliance as defined in Article 1603 of the Civil Code;
 
(ii) the warranty against latent defined in Articles 1641 and following of the Civil Code vices;
 
(iii) ensuring compliance defined in Articles L. 211-4 and following of the Consumer Code.
 
Pursuant to Article L. 211-15 of the Consumer Code, the provisions of Articles L. 211-4, L. 211-5 and L. 211-12 of said Code and the provisions of Article 1641 of the first paragraph of Article 1648 of the Civil Code are reproduced in full below:
 
- Article L. 211-4 of the Consumer Code:
 
"The seller must deliver goods in conformity with the contract and liable for defects of conformity existing at the time of delivery.
 
It also addresses the lack of conformity resulting from the packaging, instructions for assembly or installation when it was put to him by the contract or carried out under its responsibility. "
 
- Article L. 211-5 of the Consumer Code:
 
"To comply with the contract, the property must:
1 Be suitable for the purpose usually of a similar and appropriate use:
- Correspond to the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model;
- Features that a buyer might reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;
2 Or have the features defined by mutual agreement by the parties or be suitable for any particular purpose for which the buyer made known to the seller and the latter agreed. "
 
- Article L. 211-12 of the Consumer Code:
 
"The action resulting from lack of conformity within two years after delivery of the goods. "
 
- Article 1641 of the Civil Code:
 
"The seller must guarantee against hidden defects of the thing sold which render it unfit for the use for which it was intended, or that decrease this use that the buyer would not have acquired defects or n 'have paid a lower price if he had known. "
 
- First paragraph of Article 1648 of the Civil Code:
 
"The action resulting from latent defects must be brought by the purchaser within two years after discovery of the defect. "
 
 
Article 9 - Liability
 
9.1 Use of the Site
 
TridyMaker offers no guarantee of continuity of access to the Site, being held in this way as an obligation of means.
 
Responsibility TridyMaker can not be held liable for any damages related to the temporary inability to access available through the Service website.
 
9.2 Use of printed objects
 
The Customer undertakes to use the printed TridyMaker for purely decorative or pleasure objects.
 
Accordingly, the Client acknowledges and agrees that the responsibility for TridyMaker not be engaged in case the printed TridyMaker objects would be used by the Client for any purpose other than decorative.
 
 
Article 10 - Intellectual property
 
10.1 The Customer expressly declares that the free disposal of intellectual property rights on models or other material transmitted TridyMaker for carrying out the Services. In particular, if the elements are protected TridyMaker transmitted in whole or in part by copyright and / or industrial property rights (patents or design & model), the Customer declares to use it freely (s) right (s).
 
Accordingly, the Customer warrants TridyMaker against any challenge or appeal by third parties, particularly against any action for infringement is brought to him.
 
10.2 These involve no transfer of any intellectual property rights to the Customer on the created models and objects printed TridyMaker following a modeling.
 
The Customer acknowledges and agrees that TridyMaker remains the sole owner of the intellectual property rights on these models and objects.
 
 
Article 11 - Personal data
 
11.1 The communication TridyMaker by the Customer during the ordering procedure described in Article 4 of the personal data concerning him is necessary for the conclusion and execution of these general conditions. These data are collected and processed in accordance with the law n ° 78-17 of 6 January 1978, for enforcement of these terms and promotion activities TridyMaker, as well as for statistical purposes. The Customer is expressly informed that the personal data concerning him are not subject to any transfer, whether gratuitously or for consideration, to any third party. [A5]
 
11.2 TridyMaker is responsible for processing referred to in Article 11.1, said treatment having been a prior declaration to the Commission Nationale Informatique et Libertés.
 
11.3 The Customer has a right of access, right of rectification and the right of removal of personal data concerning him. Customer may also object, for legitimate reasons, the processing of data. The Client may exercise any or all of these rights by sending a letter to that effect to the following address: info@tridymaker.com
 
 
Article 12 - Applicable Law and Settlement of Disputes
 
12.1 These terms and conditions are subject to French law.
 
12.2 All disputes arising from these Terms and Conditions may result, for both their acceptance, validity, interpretation, execution, their cessation, its consequences and its consequences, are competent French courts under common law.
